Privacy Policy

This Privacy Policy explains how Negletek ("we", "us", "our"), the company behind Fonivo, handles personal data when you visit our website, create an account, or use the Fonivo voice agent. Please note: this document is a template provided for transparency and is pending final legal review before launch; specific terms may change. 1. Introduction

Fonivo is a voice agent that answers, books, and sells on phone calls on behalf of businesses. Operating this service involves processing personal data, including the content of phone conversations. We take that responsibility seriously and aim to be clear about what we do and why.

This policy applies to our marketing website, our web application, and the telephony services we provide. It does not cover third-party websites or services that we link to but do not control.

2. Information we collect

Account data: when you sign up we collect information such as your name, business name, email address, phone numbers, billing details, and authentication credentials.

Usage data: we collect technical information about how you interact with the service, including log data, device and browser information, IP address, configuration settings, and feature usage.

Call data: to deliver the service we process inbound and outbound call metadata (such as caller number, time, and duration), audio recordings, transcripts of conversations, and any information a caller provides during a call (for example a booking time, an order, or contact details).

3. How we use information

We use personal data to provide, operate, and maintain the service; to answer and route calls; to generate transcripts and summaries; to schedule bookings and process the requests your callers make; and to bill you.

We also use data to secure the service, prevent abuse, debug issues, provide support, comply with legal obligations, and — where permitted — to improve the quality and accuracy of our voice agent.

4. Call recording & transcription

Fonivo records and transcribes phone calls so the voice agent can understand callers and so you have a record of each conversation. Recordings and transcripts are processed by us and by our subprocessors strictly to deliver and improve the service.

Important: you, as the business using Fonivo, are responsible for notifying callers that calls may be recorded and transcribed and for obtaining any consent required by the laws applicable to you and your callers. We provide tools to help, but the legal duty to inform and obtain consent rests with you.

5. Legal bases for processing

Where the EU General Data Protection Regulation (GDPR) applies, we process personal data on one or more of the following legal bases: performance of a contract (to provide the service you signed up for); legitimate interests (to secure, support, and improve the service); compliance with a legal obligation; and consent, where required.

For personal data we process on your behalf as a processor, you are the controller and you are responsible for establishing the appropriate legal basis for processing your callers' data.

6. Data sharing & subprocessors

We do not sell personal data. We share data with trusted subprocessors who help us run the service, under contracts that require them to protect it and use it only on our instructions.

Our subprocessors include telephony providers (such as Twilio), voice and speech providers (such as ElevenLabs), large language model providers that power the agent's reasoning, and cloud hosting and infrastructure providers. We maintain a current list of subprocessors and will update it as our suppliers change.

7. International transfers & EU data

We are an EU-based company and we prioritise keeping data within the European Economic Area where practical. Some subprocessors may process data outside the EEA.

Where personal data is transferred internationally, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses, adequacy decisions, or equivalent mechanisms, together with supplementary measures where needed.

8. Data retention

We retain personal data for as long as needed to provide the service and for the periods required to meet legal, accounting, and reporting obligations. Retention periods for call recordings and transcripts can be configured where the service allows.

When data is no longer needed, we delete or anonymise it. On termination of your account, we delete or return your data in accordance with our agreement with you and applicable law.

9. Security

We implement technical and organisational measures appropriate to the risk, including encryption in transit, access controls, least-privilege practices, logging, and regular review of our security posture.

No system is perfectly secure, but we work continuously to protect personal data and to detect and respond to incidents. If a breach affects your data, we will notify you and the relevant authorities as required by law.

10. Your rights

Subject to applicable law, you have the right to access, rectify, erase, restrict, or object to the processing of your personal data, the right to data portability, and the right to withdraw consent where processing is based on consent.

You may exercise these rights by contacting us at hello@fonivo.io. You also have the right to lodge a complaint with your local data protection supervisory authority. Where we act as a processor on your behalf, requests from your callers should generally be directed to you as the controller.

11. Cookies

Our website uses cookies and similar technologies to keep the site working, remember preferences, and understand how the site is used. You can control non-essential cookies through your browser settings or any cookie controls we provide.

12. Children

Fonivo is a business service and is not directed to children. We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us so we can address it.

13. Changes to this policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the service after changes take effect constitutes acceptance of the updated policy.
